THE PANTSUIT REPORT: Clinton Email Probe Going Nowhere Because ‘Legal Experts Agree’ Clinton Did Nothing Illegal

“Legally it doesn’t matter if the emails were marked as classified or not, since government officials are obligated to recognize sensitive material and guard against its release. But legal experts noted that such labels would be helpful to prosecutors seeking to prove she knew the information was classified, a key element of the law.”
Those interviews and the final review of the case, however, could still take many weeks, all but guaranteeing that the investigation will continue to dog Clinton’s presidential campaign through most, if not all, of the remaining presidential primaries.
No dates have been set for questioning the advisors, but a federal prosecutor in recent weeks has called their lawyers to alert them that he would soon be doing so, the sources said. Prosecutors also are expected to seek an interview with Clinton herself, though the timing remains unclear.
The interviews by FBI agents and prosecutors will play a significant role in helping them better understand whether Clinton or her aides knowingly or negligently discussed classified government secrets over a non-secure email system when she served as secretary of State.
“This is clearly disruptive to the campaign. It will take her off message and coverage about important aides being questioned is not coverage you’d like to have. However, this issue is largely dismissed by Democratic primary voters and baked into the cake for the general electorate.”

The meetings also are an indication that much of the investigators’ background work – recovering deleted emails, understanding how the server operated and determining whether it was breached – is nearing completion.
“The interviews are critical to understand the volume of information they have accumulated,” said James McJunkin, former head of the FBI’s Washington field office. “They are likely nearing the end of the investigation and the agents need to interview these people to put the information in context. They will then spend time aligning these statements with other information, emails, classified documents, etc., to determine whether there is a prosecutable case.”

Many legal experts believe that Clinton faces little risk of being prosecuted for using the private email system to conduct official business when she served as secretary of State, though that decision has raised questions among some about her judgment. They noted that using a private email system was not banned at the time, and others in government had used personal email to transact official business.
The bigger question is whether she or her aides distributed classified material in email systems that fell outside of the department’s secure classified system. But even if prosecutors determine that she did, chances she will be found criminally liable are low. U.S. law makes it a crime for someone to knowingly or willfully retain classified information, handle it in a grossly negligent manner or to pass it to someone not entitled to see it. Schindler writes: Back in October I told you that Hillary Clinton’s email troubles were anything but over, and that the scandal over her misuse of communications while she was Secretary of State was sure to get worse. Sure enough, EmailGate continues to be a thorn in the side of Hillary’s presidential campaign and may have just entered a new, potentially explosive phase with grave ramifications, both political and legal.
The latest court-ordered dump of her email, just placed online by the State Department, brings more troubles for Team Hillary. This release of over 3,000 pages includes 66 “Unclassified” messages that the State Department subsequently determined actually were classified; however, all but one of those 66 were deemed Confidential, the lowest classification level, while one was found to be Secret, bringing the total of Secret messages discovered so far to seven. In all, 1,340 Hillary emails at State have been reassessed as classified.
There are gems here. It’s hard to miss the irony of Hillary expressing surprise about a State Department staffer using personal email for work, which the Secretary of State noted in her own personal email. More consequential was Hillary’s ordering a staffer to send classified talking points for a coming meeting via a non-secure fax machine, stripped of their classification markings.

This appears to be a clear violation of Federal law and the sort of thing that is a career-ender, or worse, for normals. The chairman of the Senate Judiciary Committee termed that July 2011 incident “disturbing,” and so it is to anyone acquainted with U.S. Government laws and regulations regarding the handling of classified material.

The revelation appears to contradict testimony Defense Secretary Leon Panetta gave lawmakers in 2013, when he said there was no time to get forces to the scene in Libya, where four Americans were killed, including U.S. Ambassador to Libya Christopher Stevens.
“I just tried you on the phone but you were all in with S [apparent reference to then-Secretary of State Hillary Clinton],” reads the email, from Panetta’s chief of staff Jeremy Bash. “After consulting with General Dempsey, General Ham and the Joint Staff, we have identified the forces that could move to Benghazi. They are spinning up as we speak.”

The email was sent out at 7:19 p.m. ET on Sept. 11, 2012, in the early stages of the eight-hour siege that also claimed the lives of Foreign Service Information Management Officer Sean Smith and two former Navy SEALs, Ty Woods and Glen Doherty, private CIA contractors who raced to the aid of embattled State Department workers.
Although the email came after the first wave of the attack at the consulate, it occurred before a mortar strike on the CIA annex killed Woods and Doherty.
“This leaves no doubt military assets were offered and ready to go, and awaiting State Department signoff, which did not come,” Judicial Watch, a nonprofit government watchdog said in a statement. Read the rest of this entry »

Clinton made $3.15 million in 2013 alone from speaking to firms like Morgan Stanley, Goldman Sachs, Deutsche Bank and UBS, according to the list her campaign released of her speaking fees.
“Her closeness with big banks on Wall Street is sincere, it’s heart-felt, long-established and well known,” former Maryland Governor Martin O’Malley has said on the campaign trail.
While Clinton has given paid speeches to many groups, Wall Street banks and investment houses made up a third of her speech income.
She even made more money speaking to UBS and Goldman Sachs than her husband Bill did. Goldman Sachs in New York paid Bill $200,000 for a speech in June 2013 and Hillary $225,000 for a speech in October of that year.

Sabato predicts O’Malley or Jim Webb are more likely to go negative on Clinton in the CNN debate Tuesday, but even Bernie Sanders may be able to take a sideswipe when it comes to Wall Street.
Sanders has been outspoken that the big banks are still “too big to fail” and should be broken up.
Clinton’s anti-Wall Street policies stop far short of that, with proposals to tax short-term trading and impose a “risk fee” on big banks with assets over $50 billion. Read the rest of this entry »

Oddly, that doesn’t come up in this clip from Bloomberg’s “With All Due Respect,” where John Heilemann and Mark Halperin focus more on the short-term worst-case scenarios for Hillary Clinton. If the scrubbed server gets restored and classified material is found, plus e-mail that Hillary deleted turns out to be work-related, she could face a lot more problems than she does now, Halperin states. Heilemann replies that if the server stays scrubbed, that won’t play well either, but whose fault is that? “This story is not going away,” Halperin concludes, “and it’s of her own doing.”
It’s a pretty good look at the short-term risks for Hillary, but mostly from a political point of view. That is no longer the big risk, though. Given the referral from the IGs on just a sample of 40 e-mails, there is plenty of evidence strongly
suggesting that Hillary and her team violated two laws governing the handling of classified material, 18 USC 1924 and 18 USC 793 — both of which carry prison terms.

The Department of Justice has prosecuted people for criminal violations of both statutes, especially 1924, which was used against David Petraeus in this administration. As one former US Attorney tells the Boston Herald, a refusal to prosecute in this case would raise all sorts of red flags about favoritism, especially after Petraeus’ conviction:
“I believe there will be a concern that if they don’t in this case, that it will be perceived as preferential treatment,” said Bradley D. Simon, a former federal prosecutor, noting the Justice Department set a recent precedent by going after the high-profile general who was admired for pulling the Iraq War back from disaster….(read more here)
At a minimum, Clinton kept classified material at an unauthorized location — her house in Chappaqua, in electronic form. The referral makes that clear. WASHINGTON – Anita Kumar, Marisa Taylor, and Greg Gordon report: As pressure builds on Hillary Clinton to explain her official use of personal email while serving as secretary of state, she faced new complications Tuesday. It was disclosed her top aides are being drawn into a burgeoning federal inquiry and that two emails on her private account have been classified as “Top Secret.”
The inspector general for the Intelligence Community notified senior members of Congress that two of four classified emails discovered on the server Clinton maintained at her New York home contained material deemed to be in one of the highest security classifications – more sensitive than previously known.
“We will follow the facts wherever they lead, to include former aides and associates, as appropriate.”

The notice came as the State Department inspector general’s office acknowledged that it is reviewing the use of “personal communications hardware and software” by Clinton’s former top aides after requests from Congress.
“Both the State Department and Intelligence Community inspectors general should be looking into the staff use of the Clinton private server for official State Department business. This means giving both inspectors general access and custody of all emails that haven’t already been deleted.”
“We will follow the facts wherever they lead, to include former aides and associates, as appropriate,” said Douglas Welty, a spokesman for the State Department’s inspector general.
“From what is publicly known, it appears that the investigation thus far has focused so much on the former secretary of state, that it’s gotten lost that high-level staff apparently also used this server too.”

Despite the acknowledgment, the State Department inspector general’s office has left numerous unanswered questions, including exactly who and what is being investigated. The office initially declined to comment and referred questions to the Intelligence Community inspector general’s office, which said it is not currently involved in any inquiry into aides and is being denied full access to aides’ emails by the State Department. Clinton, herself, is not a target.

The expanding inquiry threatens to further erode Clinton’s standing as the front-runner for the Democratic presidential nomination. Since her reliance on private email was revealed in March, polls in crucial swing states show that increasing numbers of voters say Clinton is not honest and trustworthy, in part, because of her use of private emails.

Sarah Westwood reports: A federal judge ordered Hillary Clinton and two of her top aides not to delete any potentially work-related emails after Clinton’s former chief of staff vowed to discard all electronic copies of her records by Monday.

Judge Emmet Sullivan of the U.S. District Court also demanded Clinton, Cheryl Mills and Huma Abedin provide assurances by
Wednesday that they would not delete any federal records in their possession.
The order came Friday evening in a Freedom of Information Act lawsuit filed by Judicial Watch seeking documentation of a controversial employment status bestowed on Abedin, Clinton’s deputy chief of staff, that allowed her to work simultaneously for the State Department, the Clinton Foundation and a consulting firm called Teneo Strategies.
After Sullivan asked Clinton, Mills and Abedin to certify under penalty of perjury that they had each submitted all work-related emails, only Clinton reportedly responded.

Mrs. Clinton will giver her deposition on the morning of July 28 in Washington, and Mr. Clinton will give his the following morning, according to copies of the notices of deposition reviewed by The Washington Times.
“It is simply part of a criminal enterprise which dates back at least 10 years, all designed to enrich themselves personally at the expense of the American people and our nation.”
The case, filed by Freedom Watch founder and former federal prosecutor Larry Klayman, alleges the couple committed criminal violations under the Racketeer Influenced and Corrupt Organizations Act (RICO).

The blog post comes three days after Reuters reported that the Foundation was refiling up to five years of annual tax returns after the news organization pointed out several errors in how the Foundation reported donations from foreign governments.
“So yes, we made mistakes, as many organizations of our size do, but we are acting quickly to remedy them, and have taken steps to ensure they don’t happen in the future.”
The bulk of the blog post, entitled “A commitment to Honesty, Transparency, and Accountability,” doubled down on the Clinton Foundation’s defense of its “commitment to transparency.” But the last two paragraphs admitted the error. Read the rest of this entry »

Amid suggestions that foreign governments donated to the foundation in hopes of getting special treatment from President Obama’s State Department when Clinton was his top diplomat, the group on Friday said a “thorough review” is needed….(read more)

Common Cause Urges Independent Audit of Donations to Clinton Foundation
Citing concerns about potential conflicts of interest and the influence of hidden overseas donors, Common Cause called on presidential candidate Hillary Rodham Clinton and the Clinton Foundation today to commission an independent and thorough review of all large donations to the foundation and to release the results.
“As Mrs. Clinton herself observed earlier this week, voluntary disclosure is not enough,” said Common Cause President Miles Rapoport. “A report in Thursday’s New York Times indicates that the Clinton Foundation violated an agreement to identify all of its donors. The foundation’s omissions create significant gaps in the information that voters need to make informed decisions at the polls.”
To ensure that the audit is complete, Rapoport said the foundation should enter into a contractual agreement with auditors to open its books fully and to make public the complete report of their review.
And to further guard against potential conflicts of interest, the foundation should stop accepting donations from foreign governments and foreign corporations, he said.
“There already is too much ‘dark money’ in our elections, in the form of spending by supposedly independent nonprofit groups that are not required to disclose their donors and operate as sort of shadow campaigns,” Rapoport said. “The Clinton Foundation and any other foundations tied to a candidate or his or her family provide one more way for potential donors to gain access and curry favor from candidates — without the public knowing about it. Republican Rep. Trey Gowdy of South Carolina says he wants Clinton to testify the week of May 18 and again before June 18. The first hearing would focus on Clinton’s use of private emails; the second on the September 2012 attacks that killed four Americans, including the U.S. ambassador to Libya.
Gowdy’s action comes a day after the GOP-led panel signaled its final report could slip to next year, just months before the presidential election. Clinton is the leading Democratic candidate.

Hillary Clinton: Former defense secretary. Former senator. Former First Lady. Former gamer?
The William J. Clinton Presidential Library Instagram account shared a candid photo of HRC from 1993, presumably flying on Air Force One, playing a gigantic, old Game Boy.
But the burning question is what is Hill playing so intently?
