State Department Office Removed Benghazi Files After Congressional Subpoena

Alana Goodman reports: State Department officials removed files from the secretary’s office related to the Benghazi attack in Libya and transferred them to another department after receiving a congressional subpoena last spring, delaying the release of the records to Congress for over a year.
Attorneys for the State Department said the electronic folders, which contain hundreds of documents related to the Benghazi attack and Libya, were belatedly rediscovered at the end of last year.
They said the files had been overlooked by State Department officials because the executive secretary’s office transferred them to another department and flagged them for archiving last April, shortly after receiving a subpoena from the House Select Committee on Benghazi.
The new source of documents includes electronic folders used by senior officials under Secretary of State Hillary Clinton. They were originally kept in the executive secretary’s office, which handles communication
and coordination between the secretary of state’s office and other department bureaus.
The House Benghazi Committee requested documents from the secretary’s office in a subpoena filed in March 2015. Congressional investigators met with the head of the executive secretary’s office staff to discuss its records maintenance system and the scope of the subpoena last April. That same month, State Department officials sent the electronic folders to another bureau for archiving, and they were not searched in response to the request.

The blunder could raise new questions about the State Department’s records process, which has come under scrutiny from members of Congress and government watchdogs. Sen. Chuck Grassley (R., Iowa), chairman of the Senate Judiciary Committee, blasted the State Department’s Freedom of Information Act process as “broken” in January, citing “systematic failures at the agency.”
The inspector general for the State Department also released a report criticizing the agency’s public records process in January. The report highlighted failures in the executive secretary’s office, which responds to records requests for the Office of the Secretary.
Since last fall, the State Department has taken additional steps to increase transparency, recently hiring a transparency coordinator.
But the late discovery of the electronic folders has set back the release of information in a number of public records lawsuits filed against the State Department by watchdog groups.
The State Department first disclosed that staffers had discovered the unsearched folders in a January court filing. Attorneys for the department asked the court for additional time to process and release the documents in response to a 2014 lawsuit filed by the government ethics group Judicial Watch.
Around the same time, the State Department alerted the House Select Committee on Benghazi to the discovery. On April 8, the department turned over 1,100 pages of documents from the electronic folders to the House Benghazi Committee, over a year after the committee’s subpoena. Alana Goodman reports: The fired House staffer who is accusing the Benghazi select committee of running an anti-Clinton witch-hunt also moonlights as a professional storyteller around the Washington, D.C., metro area.
Maj. Bradley Podliska, who is suing the committee after getting axed in June, claims the panel is running a “partisan” probe against Clinton. The committee’s chairman, Rep. Trey Gowdy (R., S.C.), called Podliska’s allegations “sensationalist and fabulist” on Sunday. The committee said that Podliska was fired after mishandling classified information and using resources for an unrelated PowerPoint project.
The former staffer has some experience with storytelling. Podliska performed last year with the live Virginia-based storytelling group “Better Said Than Done,” where he recounted a terrible blind date he went on as part of the Washington Post’s “DateLab” feature in 2011.
His story started out mild and self-deprecating, but he soon launched into a tirade of insults against the woman.
According to Podliska, his date was a drunken disaster who “liked to drink like a fish” and told him to “quit the chit-chat, I’m here to drink on the Washington Post’s dime” when he attempted polite conversation.

By the end of the night, Podliska said, the woman “was looking as if she had run 300 miles in a tornado, while jumping on a trampoline, all while upside down, underwater. In other words, she was two sheets to the wind.”

The State Department released Friday its first round of emails from Hillary Clinton’s time as Secretary of State, offering a new look at her handling of the attacks on the U.S. consulate in Benghazi.
“The Committee’s interest is in building a complete record from which the final, definitive accounting regarding the terrorist attacks in Benghazi can be provided.”
The roughly 300 emails, about 850 pages, are part of the 30,000 that she turned over to State from her private email server, which she used almost exclusively to conduct both private and public business during her time at State.
“The emails we release today do not change the essential facts or our understanding of the events before, during, or after the attacks,” the State Department tweeted shortly after the announcement.
Facing considerable backlash and deep skepticism over her use of a private server as she makes her second bid for the White House, Clinton asked State to make her emails public this past March, and repeated her public push to have them released on the campaign trail this week.
“The best way to answer all questions related to the attacks in Benghazi continues to be having access to the full public record, not a ‘record’ controlled, possessed and screened exclusively by Secretary Clinton’s personal lawyers.”
The State Department initially planned to release them in January 2016, but a federal judge ruled this week that there should be a “rolling production” of the emails, and they must be disclosed publicly in batches before then. Clinton called for State to expedite their release this 
week in Iowa, saying “nobody has a bigger interest in getting [the emails] released than I do.”
“We will not reach any investigative conclusions until our work is complete, but these emails continue to reinforce the fact that unresolved questions and issues remain as it relates to Benghazi.”

A congressional panel investigating the Benghazi attacks, meanwhile, has had the emails related to Benghazi and Libya since February.
Details of Clinton’s email habits that have trickled out over the past few months suggest she used email sparingly, mostly for logistics and to forward information to aides. She’s said previously that she was careful to never use email to exchange classified information, and the initial batch isn’t expected to show otherwise — the highest classification of messages was “sensitive but unclassified.”
On Thursday, the New York Times published a portion of the emails relating to Benghazi, which include a handful from controversial Clinton ally Sidney Blumenthal tipping Clinton off to volatile conditions on the ground in Libya, including one blaming the Benghazi attacks on an anti-Muslim video, which he later walked back. (WASHINGTON)— Matthew Daly reports: The chairman of a House committee investigating the 2012 attacks on Americans in Benghazi, Libya, has called former Secretary of State Hillary Rodham Clinton to testify
next month, setting up a high-profile showdown over Clinton’s use of a private email account and server while she was secretary of state.
Republican Rep. Trey Gowdy of South Carolina says he wants Clinton to testify the week of May 18 and again before June 18. The first hearing would focus on Clinton’s use of private emails; the second on the September 2012 attacks that killed four Americans, including the U.S. ambassador to Libya.
Gowdy’s action comes a day after the GOP-led panel signaled its final report could slip to next year, just months before the presidential election. Clinton is the leading Democratic candidate.

Emails disclosed by a hacker show a close family friend was funneling intelligence about the crisis in Libya directly to the Secretary of State’s private account starting before the Benghazi attack.

Jeff Gerth and Sam Biddle report: Starting weeks before Islamic militants attacked the U.S. diplomatic outpost in Benghazi, Libya, longtime Clinton family confidante Sidney Blumenthal supplied intelligence to then Secretary of State Hillary Clinton gathered by a secret network that included a former CIA clandestine service officer, according to hacked emails from Blumenthal’s account.
They came to light after a hacker broke into Blumenthal’s account and have taken on new significance in light of the disclosure that she conducted State Department and personal business exclusively over an email server that she controlled and kept secret from State Department officials and which only recently was discovered by congressional investigators.
The emails, which were posted on the internet in 2013, also show that Blumenthal and another close Clinton associate discussed contracting with a retired Army special operations commander to put operatives on the ground near the Libya-Tunisia border while Libya’s civil war raged in 2011.
Blumenthal’s emails to Clinton, which were directed to her private email account, include at least a dozen detailed reports on events on the deteriorating political and security climate in Libya as well as events in other nations. They came to light after a hacker broke into Blumenthal’s account and have taken on new significance in light of the disclosure that she conducted State Department and personal business exclusively over an email server that she controlled and kept secret from State Department officials and which only recently was discovered by congressional investigators.
“The contents of the memos, which have recently become the subject of speculation in the right-wing media, raise new questions about how Clinton used her private email account and whether she tapped into an undisclosed back channel for information on Libya’s crisis and other foreign policy matters.”
The contents of that account are now being sought by a congressional inquiry into the Benghazi attacks. Clinton has handed over more than 30,000 pages of her emails to the State Department, after unilaterally deciding which ones involved government business; the State Department has so far handed almost 900 pages of those over to the committee. A Clinton spokesman told Gawker and ProPublica (which are collaborating on this story) that she has turned over all the emails Blumenthal sent to Clinton.
The dispatches from Blumenthal to Clinton’s private email address were posted online after Blumenthal’s account was hacked in 2013 by Romanian hacker Marcel-Lehel Lazar, who went by the name Guccifer. Lazar also broke into accounts belonging to George W. Bush’s sister, Colin Powell, and others. “Thus, there are no hdr22@clintonemail.com emails from Secretary Clinton’s tenure as secretary of state on the server for any review, even if such review were appropriate or legally authorized,” Mr. Kendall said in a letter to the House select committee investigating the 2012 attacks in Benghazi, Libya.
The committee subpoenaed the server this month, asking Mrs. Clinton to hand it over to a third party so it could determine which emails were personal and which were government records.
At a news conference this month, Mrs. Clinton appeared to provide two answers about whether she still had copies of her emails. First, she said that she “chose not to keep” her private personal emails after her lawyers had examined the account and determined on their own which ones were personal and which were State Department records. But later, she said that the server, which contained personal communication by her and her husband, former President Bill Clinton, “will remain private.” The server was kept at their home in Chappaqua, N.Y., which is protected around the clock by the Secret Service.

Hillary Clinton wiped “clean” the private server housing emails from her tenure as
secretary of state, the chairman of the House committee investigating the 2012 terrorist attacks in Benghazi said Friday.
Clinton was under a subpoena order from the Select Committee on Benghazi for all documents related to the 2012 attacks on the American compound there. But David Kendall, an attorney for Clinton, said the 900 pages of emails previously provided to the panel cover its request.

Look To Huma’s and Cheryl’s Emails
Dick Morris writes: Don’t expect a gold mine of emails on Hillary’s private account. Why not? Because she doesn’t know how to type. That’s right. She writes everything out in longhand. Really. Anyone who has spent time in meetings with her knows about her endless yellow pads.
“Anything more than a few lines were most likely written by someone else on her behalf. There’s a reason why Hillary set up and used private emails with them for official business: all the important emails were likely written by her staff. Without access to them, we won’t know what was going on.”
So her emails will most likely turn out to be very short and quick. She wouldn’t spend a lot of time pecking out long letters. No way. That’s why the Benghazi Committee needs to also look very closely at the emails on private accounts 
that Hillary’s closest aides, Huma Abedin and Cheryl Mills, maintained. Anything more than a few lines were most likely written by someone else on her behalf. There’s a reason why Hillary set up and used private emails with them for official business: all the important emails were likely written by her staff. Without access to them, we won’t know what was going on.

Hillary Clinton’s Response to Gowdy’s Letter is Due by April 4

Trey Gowdy, the chairman of the House Select Committee on Benghazi, has sent a letter to former Secretary of State Hillary Clinton’s attorney requesting that she turn over her private email server to the State Department‘s Inspector General or to another neutral third party.
“The Committee must have objective assurances it, and by extension the House of Representatives as a whole, has received all relevant information requested and necessary for a thorough investigation into what happened before, during and after the attacks in Benghazi, Libya,” he wrote in the letter. “More broadly, the equities in these emails extend beyond this Committee. The House of Representatives and the American people are entitled to a complete accounting of the Secretary’s official record during her time as Secretary of State.”

A conservative magazine reported Wednesday that Clinton’s State Department chief and deputy chief of staff both had the private addresses.

The Weekly Standard‘s Stephen Hayes claimed on Fox News that the State Department has evidence Abedin and Cheryl Mills, Clinton’s two top aides, both used private email addresses for government work
Clinton has come under fire for exclusively using her own ‘clintonemail.com’ address while she was America’s top diplomat.
She admitted Tuesday during a news conference at the United Nations that she deleted more than 30,000 emails she decided were personal in nature and unrelated to her job.
Separately from claims by The Weekly Standard, the gossip website Gawker reported this month that Abedin and Phillippe Reines, Clinton’s top communications strategist, had the private addresses. Abedin married into a separate scandal when she wed former congressman Anthony Weiner, whose sexting exploits landed him on front pages and hastened his departure from Congress.
Daily Mail Online was able to confirm Abedin’s email address through Lexis-Nexis, a commercial service that compiles public records.
‘Huma@clintonemail.com’ was one of several of Abedin’s email addresses Nexis collected in conjunction with other public records.
Email addresses typically land in the Nexis database when people list them on credit applications, mortgage paperwork or other legal documents.
Her first public words about ’email-gate’ attracted a crush of reporters at the United Nations
Searches for similar email addresses belonging to Reines and Mills were unsuccessful, as were searches for email addresses belonging to current and former State Department spokeswoman Victoria Nuland, Jen Psaki and Marie Harf, along with current Clinton spokesman Nick Merrill.
Merrill told Gawker this month that Reines ‘has never had’ an email address on the private Clinton server, ‘not for communicating with anyone about anything.’
But Merrill wouldn’t say whether Reines used a separate private account to conduct government business with Clinton. Read the rest of this entry »

Mrs. Clinton is the sole arbiter here of what is ‘preserved,’ made public, or available to freedom of information requests or to congressional overseers. Don’t think any of this was by accident

writes: Hillary Clinton has made some disingenuous statements over her political career, but none remotely compare to the tweet she issued Wednesday night: “I want the public to see my email,” she said. This requires—how to say it—a willing suspension of disbelief.

Mrs. Clinton was referring to the gracious permission she had just bestowed upon the State Department to release her email correspondence as the nation’s former top diplomat. She’s only in a position to grant such favors because it turns out all of her correspondence as Secretary of State was conducted on private email, run out of a server she alone controlled. The Clinton camp has spent this week explaining that none of this was untoward, that no laws were broken, and that she’s being transparent.
“The beauty of the Clinton home-brew system is that it puts her in total control. She runs the Clinton email cloud. She alone decides what documents to hand to State. This is why her agreement to allow State to release the 55,000 pages she has now sent it is hilariously hollow; she’s agreeing only to the release of emails she’s selectively provided.”
Were you just awakening from a 40-year coma and still a bit fuzzy, this might strike you as remotely plausible. For everyone else who has lived through the Bill and Hill years, this email caper is pure Clinton.
First, historical context. There are few politicians alive today who have a better understanding than the Clintons of the perils of paper trails—and the benefits of not having them. It really wasn’t all that long ago that Mrs. Clinton was failing to answer questions about how her Rose Law firm billing records vanished. Or using executive privilege to sit on documents that showed her involvement in the Travel Office firings. Or grappling with testimony from a Secret Service agent who said Mrs. Clinton’s top aide had removed files from Vince Foster ’s office. Or explaining her connection to Sandy Berger, who was prosecuted for stealing Clinton-related National Archives records.

If you don’t think all this wasn’t informing Mrs. Clinton’s decision—on the day of her first confirmation hearing—to register clintonemail.com, you aren’t thinking.
Mrs. Clinton’s decision to ignore records laws also has to be viewed in the context of what she knew. In recent years she served as a senator and secretary of state, where she’d have been through rounds of ethics training. Jeffrey Scott Shapiro and Kelly Riddell report: The chairman of a special House committee created to investigate the 2012 Benghazi tragedy on Monday instructed his staff to review secretly recorded tapes and intelligence reports that detail Hillary Rodham Clinton’s role in advocating and executing the war in Libya, opening the door for a possible expansion of his probe.
Rep. Trey Gowdy’s decision to seek a review of the materials, first highlighted in a series of Washington Times stories last week, carries consequences for the 2016 election in which Mrs. Clinton is expected to seek the presidency. It could also move the committee to examine the strained relationship between the State Department and Pentagon, which sharply disagreed over the 2011 war in Libya and the response to the terrorist attack on the U.S. compound in Benghazi a year later.
The Times reported last week that U.S. intelligence did not support Mrs. Clinton’s story of an impending genocide in Libya that she used to sell the war against Moammar Gadhafi’s regime. The newspaper also unveiled secretly recorded tapes from Libya that showed that the Pentagon and Democratic Congressman Dennis Kucinich so distrusted her stewardship of the war that they opened their own diplomatic channels with the Gadhafi regime.
The tapes included candid conversations and allegations that Mrs. Clinton took the U.S. to war on false pretenses and was not listening to the advice of military commanders or career intelligence officers.
“Chairman Gowdy and the committee are aware of the details reported by The Washington Times, and we are reviewing them as part of the committee’s inquiry into Benghazi,” Benghazi Committee spokesman Jamal Ware announced Monday.
The emergence of the tapes and a new line of inquiry immediately had repercussions, especially on the political front where the 2016 president race has heated up.
Sen. Rand Paul of Kentucky, a 2016 GOP hopeful who has been intensely critical of Mrs. Clinton’s handling of the 2011 Libya intervention, said the stories demonstrate she is not the right person to lead the country or the nation’s military.
“Hillary’s judgment has to be questioned – her eagerness for war in Libya should preclude her from being considered the next Commander in Chief,” said Sen. Paul, who opposed the Libyan intervention at the onset. Read the rest of this entry »

“Benghazi was not the first time our diplomatic facilities and people have been attacked,” Gowdy said. “The barracks in Beirut, our facilities in Tanzania and Kenya are a few that come to mind amid too many others.”
“I remain hopeful there are still things left in our country that can transcend politics,” South Carolina Republican Rep. Trey Gowdy, the chairman of the committee, said in his opening statement in a Capitol Hill hearing room. “I remain convinced our fellow citizens deserve all of the facts of what happened before, during, and after the attacks in Benghazi and they deserve an investigative process worthy of the memory of those who died and worthy of the trust of our fellow citizens.”
“So to those who believe it is time to move on, that there is nothing left to discover, that all questions have been asked and answered, that we have learned the lessons to be learned — we have heard that before. And yet the attacks and the tragedies keep coming.”

UPDATE: Other news organizations confirm the report below that House speaker John Boehner will announce the formation of a select committee on Benghazi, led by Rep. Trey Gowdy.
House Speaker John Boehner is “seriously considering” appointing a select committee to investigate the attacks on the U.S. diplomatic post in Benghazi, Libya, according to a senior GOP leadership aide. The move comes after the revelation of an email from a top Obama national security official, Ben Rhodes, instructing Susan Rice to focus on an anti-Muslim internet video to explain the attacks.
“For the first time we have clear and public evidence that the White House was more involved in misleading the American people than it had previous admitted. And, second, it’s now proven that the administration withheld relevant documents from a congressional subpoena request…”
“The new emails this week were the straw that broke the camel’s back,” says the aide. “The Speaker was furious to learn that the admininstration withheld relevant documents from a congressional subpoena. He’s sick and tired of this evasion and obstruction from the administration, and wants a solution to finally force accountability, get to the truth, and provide justice.”
“…the administration has now demonstrated it is willing to flagrantly defy such subpoena requests, compelling the House to consider taking the strongest actions possible in an effort to ensure Americans have the truth about what happened.”
Boehner, who has paid careful attention to the Benghazi developments since the attacks, has resisted calls to appoint a select committee, preferring to allow the various committees of jurisdiction to pursue investigations of their slices of the attacks on their own. Aides say Boehner continues to believe that the work of those committees has been valuable. “The current committees investigating the attack have done good work, using their authority, including subpoena authority, to gather facts, interview hundreds of witnesses, and conduct dozens of hearings. But this week’s events demonstrate a new level of stonewalling and obfuscation by the administration that requires a new level of investigation.”

The American people still need to hear from Lois Lerner. That’s a point that can’t be made often enough.
Remember her? She’s the IRS official who gave a statement before Congress declaring herself innocent of any wrongdoing — and then promptly took the Fifth.Recently, Congress unearthed another IRS e-mail on which she was copied, talking about taking “off-plan” a discussion about how to harass the 501(c)4 groups the IRS had targeted. Meanwhile, leaks from officials involved in the investigation claim the FBI has not found anything criminal.
